1. Agreement

These Terms of Use ("Terms") govern access to and use of Brift, an AI-powered sales agent platform operated by Brift ("Brift", "we", "us"). By creating an account, installing the widget, or otherwise using the service, you agree to these Terms and our Privacy Policy.

2. Service description

Brift provides software that lets you deploy a conversational sales agent on your website or digital properties. The agent engages visitors, qualifies leads, simulates ROI, handles objections, and logs conversations in your account. Features, limits, and availability may vary by plan and may evolve over time.

3. Account and eligibility

You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old and have authority to bind the organization you represent, if applicable.

4. Subscription and billing

Paid plans, trial terms, renewal, and cancellation conditions are presented before checkout. Unless stated otherwise, subscriptions renew automatically until cancelled in accordance with the flow shown at purchase. Prices and taxes are displayed before payment confirmation.

5. Acceptable use

You agree not to:

• Use Brift for unlawful, deceptive, or abusive purposes.
• Upload or generate content that infringes third-party rights or applicable law.
• Attempt to bypass security, scrape the service, or interfere with its operation.
• Resell or sublicense the service except as expressly permitted in writing.
• Use the agent to collect sensitive data categories you are not authorized to process.

6. Your content and data

You retain ownership of content you provide (website copy, materials, conversation data). You grant Brift a limited license to host, process, and display that content solely to operate and improve the service. Data handling is described in our Privacy Policy.

7. Intellectual property

Brift, its software, branding, and documentation remain our property or that of our licensors. No rights are granted except as necessary to use the service under these Terms.

8. Disclaimers

The service is provided on an "as is" and "as available" basis. AI-generated responses may be inaccurate or incomplete. You are responsible for reviewing agent behavior, offers, and compliance obligations on your properties before relying on outputs in a commercial or legal context.

9. Limitation of liability

To the maximum extent permitted by law, Brift is not liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, data, or business opportunities. Our aggregate liability arising from the service is limited to the amounts you paid to Brift in the twelve (12) months preceding the claim, except where liability cannot be limited under applicable law.

10. Suspension and termination

You may stop using the service at any time. We may suspend or terminate access if you materially breach these Terms, create security risk, or fail to pay amounts due. Upon termination, your right to use the service ends; export and deletion options are described in the Privacy Policy.

11. Changes

We may update these Terms. Material changes will be communicated through the service or by reasonable notice. Continued use after the effective date constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by French law, without prejudice to mandatory consumer protections in your country of residence. Disputes shall be submitted to the competent courts unless otherwise required by applicable law.
